Adventures in Real Estate - Lawyer Schenanigans

This story takes place back in 2018 when my investor clients acquired a wonderful single-story Thousand Oaks home with views of the Wildwood mountains at a foreclosure sale. I had posted the required notice for eviction on the door and we had started having conversations with the owner and setup a time to meet to arrange with the prior owner for them to leave. The meeting got canceled because the prior owner received a mailing from a Las Vegas based attorney who said he could fight the eviction. In reality, there isn't anything they can do in these situations but people don't know this.

My clients proceed with the eviction and we have a court date. Prior to the date, there is a bankruptcy filed by a tenant of the house, not the former owner. I get a copy of the information from our eviction attorney and find out that this four bedroom house has seven tenants PLUS the prior owner living there, for a total of eight people. I put on my Open Source Investigator hat and I start my research. The first thing I noticed, was the rental lease agreement was an outdated form which was not in use at the time the agreements were signed. No Realtor would have been able to use that version of the form as outdated versions are replaced when a new version gets released and this form was two revisions prior to the date of the signatures. I then researched the people. Each and every one of them were living their best life in Nevada. Vegas, Summerland, and surrounding cities. None of them had any indication on their wide-open social media pages that they had ever set foot in Thousand Oaks, let alone rented a house here. Some of them had photos of their kids going to school out there and I think one had bought a house out there around the time they supposedly leased the house in Thousand Oaks. I compiled the evidence and wrote a report which I presented to our attorney. Our attorney used it in the court proceedings and got the evictions to happen. Turns out, my research was spot-on. None of the leases were valid. The attorney had been using his client's from other cases information and creating false leases and filing bankruptcy without their knowledge or consent!

My attorney asked if he could send my research to the Nevada Bar Association, to which I gladly agreed. The last I heard that lawyer had been arrested for fraud and identity theft and has been disbarred. Once again showing that having an Broker like me, who knows how to fight for his clients, is crucial in this business.

This story has a very happy ending. Not only did yet another bad guy end up a guest of the state, but my clients were able to get into the house without much delay, did an incredible remodel on it, and I sold it to a fantastic family who I am sure are enjoying it immensely still to this day.
